China’s top legislature, the National people’s Congress’ yesterday adopted an amendment to the Administrative Procedure Law aiming to expand the people’s right to sue the government.

I think Communist party of China is getting more open gradually and these are some of the most welcome movement. But in general, there is another suspicion: how the Chinese administration ensure the impartiality of the judiciary/court in China? Because in China, everything including the judiciary is under the control of the Communist party. So in theory, the judge might not be interested to give verdict against the local administration or the representative of the Communist party…!! Also sometimes the judges are under pressure from the communist party as well & they need to look into their and their families security as well, as in China, police is also under the control of communist party. I think impartiality or non-impartiality of judiciary is a big question in China.

I think Communist party of China is getting more open gradually and these are some of the most welcome movement. But in general, there is another suspicion: how the Chinese administration ensure the impartiality of the judiciary/court in China? Because in China, everything including the judiciary is under the control of the Communist party. So in theory, the judge might not be interested to give verdict against the local administration or the representative of the Communist party…!! Also sometimes the judges are under pressure from the communist party as well & they need to look into their and their families security as well, as in China, police is also under the control of communist party. I think impartiality or non-impartiality of judiciary is a big question in China.

不过有另一个疑问：中国当局如何确保司法公正？在中国，包括司法在内的一切都由党控制。所以理论上说来，法官也许不会做出违背当地政府利益的判决！
此外，法官有时候承受来自党的压力，他们得照顾自己和家人的安全，况且警察也是处于党的控制之下。
我认为司法公正在中国是一个大问题
