I'd imagine Apple has already patented or trademarked much of their stuff or future stuff. It would seem silly to wait until releasing it to get the patents when the tech should be enough to get those patents.

Normally a patent can only be filed by the person who invented something. I don't think that even first to file (the new worldwide patent system) allows a copier to gain rights over the copied, but if it is does then the patent world will explode.
