SUBJECT: BEIJING HUMAN RIGHTS WATCHERS DISCUSS EU HR; DIALOGUE; RAISE TIBET SHOOTING INCIDENT

1. (C) Summary: The 22nd round of the China-EU human rights dialogue took place October 19 in Beijing, with special emphasis on freedom of expression, criminal justice reform and combating racism. Ambassador Tom Gronberg of Finland, which currently holds the rotating EU Presidency, led the EU delegation in meetings covering a range of issues including freedom of expression, criminal justice
reform and combating racism.

3. (C) On freedom of expression, Ambassador Gronberg noted that that the Chinese block some Internet search terms. MFA International Organizations Director General Wu Hailong launched into a lengthy background statement on the explosion in Chinese Internet use since 1990. Wu denied that there is "any censorship whatsoever" of news items in China. Censorship is "practically impossible," Wu said, given the large number of search queries. A moment later, Wu explained that the Chinese government has banned "Taiwan" as a search term because Internet users otherwise might use it to advance "illegal separatist activities." private conversation on the margins of the dialogue.

6. (C) A public security official present at the meetings said Nowak mistakenly used the term "arbitrary detention" in describing Chinese practice. She said Nowak should have acknowledged that detentions in China are "according to law," though she did not address the question of whether Chinese law is arbitrary. The public security official also said "Reeducation-Through-Labor" is necessary in China, and is "very likely to stay." DG Wu said an inter-department group continues to work on ICCPR ratification, with some departments holding the view that the ICCPR cannot be ratified because it "totally contravenes Chinese law." The public security official, though not going so far as to say that the ICCPR cannot be ratified, said she is certain the
ratified version will include an exception allowing various forms of administrative detention including RTL because they have a "long and important tradition" in China.

He said the Chinese Government is likely to take up organ donation as a topic for further legislative or regulatory action. told EU human rights interlocutors he thought their
"border guards would have acted the same way." EU
human rights officials passed a list of 76 prisoner
cases to the Chinese several days before the dialogue.
The EU received substantive responses in 11 cases and
the Chinese have promised additional responses in
other cases.

dialogue generally seemed more confident than in

Ottawa, but has been stymied by MFA refusals to meet
with Canadian Embassy officials in Beijing. Swedish

government raised the Tibet incident with FM Li
Zhaoxing on October 12. On October 16, a Swedish
delegation in Tibet raised the issue with local
officials, who claimed not to have heard of the

Australian Embassy delivered a demarche on the Tibet
incident last week to the MFA.

Jia Qinglin Discusses Religion With Archbishop

Archbishop of Canterbury Rowan Williams' recent visit
to China, which is the third visit by a head of the
Anglican Church to China. In an October 19 meeting,
CPPCC Chairman and Politburo member Jia Qinglin told
Williams that the formal "Decision" of the Central
Committee's recent Sixth Plenum contains the first
ever high-level Party pronouncement commenting
positively on the role of religion in China. The
"Decision" on China's future economic and social
development passed this month states: "we should
strengthen the unity among the religious masses, those
without religious belief, and those believing in
different religions and bring the positive role of
religion into play in promoting social harmony." Jia
told Williams that religion can play an important role
in China's efforts to build a "harmonious society,"
though he also affirmed that this role must be

9. (C) Ambassador Gronberg raised the September 30
shooting of Tibetans at the Nangpa Pass, asking the
Chinese for clarification and to investigate the
incident thoroughly. DG Wu agreed to investigate and
report back to the EU on thi incident as information
becomes available. However, he cavalierly ascribed
the incident to "normal border guard behavior" and
told EU human rights interlocutors he thought their
"border guards would have acted the same way." EU
human rights officials passed a list of 76 prisoner
cases to the Chinese several days before the dialogue.
The EU received substantive responses in 11 cases and
the Chinese have promised additional responses in
other cases.

10. (C) EU Delegation Representative [TEXT REMOVED BY AFTENPOSTEN]
said that Chinese participants in the October 19
dialogue generally seemed more confident than in
previous China-EU dialogue rounds, and even arrogant
at times. As evidence of this, [TEXT REMOVED BY AFTENPOSTEN] said DG Wu
simply did not pay attention to EU interlocutors
during some of the discussions. DDG Shen, [TEXT REMOVED BY AFTENPOSTEN] said,
even laughed at some comments made by EU participants.
Shen complained about the Bern Process, saying that it
"offends China's dignity." He told the EU that it
should withdraw from the Bern Process and that
pressure on the Chinese through this channel will be
"counterproductive."
Action Following Tibet Border Incident

11. (C) Several Embassies reported that they have
raised concerns about the September 30 shooting
incident near Nangpa Pass. Canadian Embassy [TEXT REMOVED BY AFTENPOSTEN]
said the Canadian Government
raised the Tibet incident with the Chinese Embassy in
Ottawa, but has been stymied by MFA refusals to meet
with Canadian Embassy officials in Beijing. Swedish
Emboff [TEXT REMOVED BY AFTENPOSTEN] reported that the Swedish
government raised the Tibet incident with FM Li
Zhaoxing on October 12. On October 16, a Swedish
delegation in Tibet raised the issue with local
officials, who claimed not to have heard of the
incident. Australian Emboff [TEXT REMOVED BY AFTENPOSTEN] said the
Australian Embassy delivered a demarche on the Tibet
incident last week to the MFA.

12. (C) Other Embassies reported plans to raise the
Tibet incident with Chinese officials. Swiss Foreign
Minister Micheline Calmy-Rey will discuss the incident
in October 27 meetings with FM Li. A German
delegation will raise the incident with MFA
International Organizations officials during the next
round of the China-German human rights dialogue on
October 30 and 31. Norway and New Zealand, whose
representatives were not present at the October 26
human rights watchers meeting, reportedly have either
raised the Tibet incident with Chinese officials or
plan to do so soon.
Jia Qinglin Discusses Religion With Archbishop

Archbishop of Canterbury Rowan Williams' recent visit
to China, which is the third visit by a head of the
Anglican Church to China. In an October 19 meeting,
CPPCC Chairman and Politburo member Jia Qinglin told
Williams that the formal "Decision" of the Central
Committee's recent Sixth Plenum contains the first
ever high-level Party pronouncement commenting
positively on the role of religion in China. The
"Decision" on China's future economic and social
development passed this month states: "we should
strengthen the unity among the religious masses, those
without religious belief, and those believing in
different religions and bring the positive role of
religion into play in promoting social harmony." Jia
told Williams that religion can play an important role
in China's efforts to build a "harmonious society,"
though he also affirmed that this role must be
"according to law." In a separate meeting with
Assistant Foreign Minister Kong Quan, Kong told
Williams that the Dalai Lama's "hidden agenda" is
Tibetan independence.
China Says It Will Not Cut Back On China-UK Dialogue

SUBJECT: PRC PROTESTS DOD CHINA MILITARY POWER REPORT

¶1. (C) Summary: Reading unenthusiastically from prepared
remarks, MFA DG for North American and Oceanian Affairs Zheng
Zeguang formally protested to the A/DCM DOD's annual report
to Congress on China's military power.  Zheng criticized the
report as containing "erroneous and unfounded" accusations
that have undermined U.S.-China relations.  China will
continue to pursue "peaceful development" and has legitimate
needs to build its military for national security purposes,
Zheng claimed.  The Taiwan portion of the report triggered a
recitation by Zheng of China's standard talking points,
followed by the assertion that China handles disputes through
consultation and in accordance with international law.  Zheng
closed with a complaint that the report had come out when
Washington and Beijing have a "stable and good beginning" for
relations under the new U.S. administration, arguing that we
need to "eradicate the negative impact" of the report to
reduce the damage done to the bilateral relationship,
particularly mil-mil relations.  The A/DCM pointed out that
the report is mandated by Congress, and encouraged China's
responsible participation in world affairs and increased

¶2. (C) MFA North American and Oceanian Affairs Department
Director General Zheng Zeguang called in the Acting DCM March
26 to discuss the 2009 DOD report to Congress on China's
military power.  Acting POL M/C and Assistant Naval Attache
accompanied the A/DCM.  Zheng stated that "last year I did
this with your predecessor after the 2008 report was
released, and now I get to do it again."  Zheng spoke in
English but worked from a text prepared in Chinese.  Zheng's
delivery was quiet and unemotional, and in setting up the
meeting, the MFA U.S. Division Director made a point of
telling Acting POL M/C that "we have to do this, let's just
get it out of the way so it will not be an issue when we are
working on our leaders' meeting."

POINT ONE: CHINA NOT HAPPY WITH THE REPORT
------------------------------------------

¶3. (C) Zheng said that before DOD issued the report, the
Chinese government had discussed the issue with USG officials
in Beijing and Washington, urging the USG to stop issuing
these reports and disseminating "untrue theories" of the
China military threat.  Zheng criticized the report for
containing "erroneous and unfounded accusations against
China," and for criticizing China's "legitimate and normal"
defense buildup.  Zheng said the report's discussion of the
PRC military threat against Taiwan is "rhetoric that serves
as an excuse for the United States to continue to sell arms
to Taiwan."

¶4. (C) Zheng protested what he described as the report's
claims that China is projecting power to ensure access to
resources and enforce claims to disputed territories, as well
as the report's "irresponsible remarks about China's naval
strategy."  The report has "seriously violated" the norms
guiding international relations and the three Sino-U.S. joint
communiques and undermined both the overall bilateral
relationship and strategic trust between our two countries,
Zheng stated.

POINT TWO: CHINA'S DEVELOPMENT "PEACEFUL"
-----------------------------------------

¶5. (C) China's adheres to a "peaceful development policy,"
Zheng continued, and will continue to pursue a security
policy that is defensive in nature.  China has all along been
"a strong force safeguarding peace and stability in Asia
Pacific and the world."

¶6. (C) Zheng advised that China is a sovereign country with
22,000 km of land borders and also 18,000 km of coastline.
To safeguard national security and territorial integrity,
China needs to continue its defense buildup.  "This is the
solemn right and responsibility for any sovereign country in

the world."  China will not participate in any arms race, and
neither will it pose a threat to any country, Zheng declared.
It is "erroneous and unacceptable" for the United States to
continue the annual practice of using the report to
disseminate and spread the idea of a "China threat."

POINT THREE: TAIWAN
-------------------

¶7. (C) Zheng reminded the A/DCM that Taiwan is an
"inalienable part" of Chinese territory, and that recent
months have seen the steady improvement and development of
the cross-Strait relationship.  He recited the PRC mantra
that China will continue to strive for peaceful development
of cross-Strait relations on the basis of mutual trust,
putting aside disputes, seeking common ground, resolving
differences and win-win.  However, no matter how the Taiwan
Strait situation evolves, China will continue to uphold the
one-China principle, oppose Taiwan independence and oppose
firmly two Chinas or One China, One Taiwan.

¶8. (C) Zheng urged the United States to abide by its
commitments on Taiwan, adopt the one-China principle, observe
the three joint communiques, oppose Taiwan independence and
oppose Taiwan's participation in any international
organization in which statehood is required for membership.
He also urged the United States to stop selling arms to
Taiwan and stop official military contacts with Taiwan so as
not to hurt the peaceful development of cross-Strait
relations and U.S.-China relations.

POINT FOUR: CHINA IS LAW-ABIDING
--------------------------------

¶9. (C) Zheng claimed that China "upholds the principle of
resolving disputes through consultation and peaceful
negotiation on the basis of international law."  He urged the
United States to "have a clear understanding of China's
policy in this regard and rectify the erroneous practice of
making irresponsible remarks about China's tactics and
policies in dealing with territorial disputes with other
countries."  He claimed that issuing the report "hurts the
trust between China and other countries and creates problems
for peace and stability in the region."

POINT FIVE: NOT NOW, WE'RE DOING SO WELL!
-----------------------------------------

¶10. (C) Zheng complained that the report was issued "just
when we have had a relatively stable and good beginning with
the new U.S. administration."  He noted the upcoming
"high-level exchanges," including the meeting between our two
presidents, and said that the current state of relations "did
not come about easily and required hard work on both sides."

PERORATION: "ERADICATE THE NEGATIVE IMPACT"
-------------------------------------------

¶11. (C) Zheng said China urges the United States "to discard
Cold War mentality and biased opinion and view China's
foreign and defense policy in an objective and fair manner."
China calls on the United States to "stop making
irresponsible remarks that hurt mutual trust and cooperation,
and stop this practice of issuing the so-called military
power report."  China also urges the United States "to take
immediate actions to eradicate any negative impact on
relations as the result of this report.  In so doing, the
United States can reduce the damage done between our two
countries and our two militaries."

DCM RESPONDS
------------

¶12. (C) The A/DCM responded that the report is mandated by
the National Defense Authorization Act of Fiscal Year 2000,
and that the report is intended to be factual, descriptive
and analytical.  It does not attempt to draw conclusions, he
said, but is intended to let the facts speak for themselves.
He noted that the report discusses weaknesses, as well as
strengths, of the PRC's military.

¶13. (C) U.S. policy seeks to establish a positive and
cooperative relationship with China, one in which we deepen
and strengthen our ties on issues of common interest and

candidly address differences where they persist, the A/DCM
said.  He quoted Secretary Clinton's statement that "this is
not a one-way effort.  Much of what we will do depends on the
choices China makes about its future at home and abroad."

¶14. (C) The A/DCM reiterated that the United States welcomes
the rise of a stable, peaceful and prosperous China, and
encourages China to participate responsibly in world affairs
by taking on a greater share of the burden for the stability,
resilience and growth of the international system.  He noted
that despite the welcome development of China's routine
publication of defense white papers (the most recent being
China's National Defense in 2008 published on January 20,
2009), much more could be said by China about its build-up of
strategic nuclear and conventional capabilities.  China has
left unclear to the international community the purposes and
objectives of the PLA's evolving doctrine and capabilities.

¶15. (C) On the subject of Taiwan, the A/DCM restated U.S.
policy by declaring that the United States remains committed
to our one China policy based on the three joint communiques
and the Taiwan Relations Act.   He said the United States
does not support Taiwan independence and believes that
cross-Strait issues should be resolved peacefully in a manner
acceptable to people on both sides of the Strait, and opposes
unilateral actions by either side to alter the status quo
across the Strait.  He took the opportunity to urge China to
work towards a peaceful resolution of its differences with
Taiwan.  He reminded Zheng that we make defense articles
available to Taiwan to allow it to maintain a credible
defense as provided for in the Taiwan Relations Act, and
urged China to reduce military deployments aimed at Taiwan
and to pursue a peaceful resolution of cross-Strait issues.

¶16. (C) Showing a bit more spark, Zheng said the United
States should recognize that it is "only a member of the
international community" and should follow the norms of
international relations and respect territorial sovereignty
and integrity.  He said that the United States should look at
China's "legitimate defense buildup" in an objective and fair
manner, and discard its Cold War mentality and zero-sum
perception of China-U.S. relations.  He protested that the
Taiwan Relations Act is "a unilateral piece of U.S.
legislation.  The three communiques signed by the United
States constitute the guiding principle for Taiwan policy,
not the TRA," he said.

not to hurt the peaceful development of cross-Strait
relations and U.S.-China relations.

POINT FOUR: CHINA IS LAW-ABIDING

¶9. (C) Zheng claimed that China "upholds the principle of
resolving disputes through consultation and peaceful
negotiation on the basis of international law."  He urged the
United States to "have a clear understanding of China's
policy in this regard and rectify the erroneous practice of
making irresponsible remarks about China's tactics and
policies in dealing with territorial disputes with other
countries."  He claimed that issuing the report "hurts the
trust between China and other countries and creates problems
for peace and stability in the region."

POINT FIVE: NOT NOW, WE'RE DOING SO WELL!

¶10. (C) Zheng complained that the report was issued "just
when we have had a relatively stable and good beginning with
the new U.S. administration."  He noted the upcoming
"high-level exchanges," including the meeting between our two
presidents, and said that the current state of relations "did
not come about easily and required hard work on both sides."

PERORATION: "ERADICATE THE NEGATIVE IMPACT"

¶11. (C) Zheng said China urges the United States "to discard
Cold War mentality and biased opinion and view China's
foreign and defense policy in an objective and fair manner."
China calls on the United States to "stop making
irresponsible remarks that hurt mutual trust and cooperation,
and stop this practice of issuing the so-called military
power report."  China also urges the United States "to take
immediate actions to eradicate any negative impact on
relations as the result of this report.  In so doing, the
United States can reduce the damage done between our two
countries and our two militaries."

DCM RESPONDS
------------

¶12. (C) The A/DCM responded that the report is mandated by
the National Defense Authorization Act of Fiscal Year 2000,
and that the report is intended to be factual, descriptive
and analytical.  It does not attempt to draw conclusions, he
said, but is intended to let the facts speak for themselves.
He noted that the report discusses weaknesses, as well as
strengths, of the PRC's military.

¶13. (C) U.S. policy seeks to establish a positive and
cooperative relationship with China, one in which we deepen
and strengthen our ties on issues of common interest and

candidly address differences where they persist, the A/DCM
said.  He quoted Secretary Clinton's statement that "this is
not a one-way effort.  Much of what we will do depends on the
choices China makes about its future at home and abroad."

¶14. (C) The A/DCM reiterated that the United States welcomes
the rise of a stable, peaceful and prosperous China, and
encourages China to participate responsibly in world affairs
by taking on a greater share of the burden for the stability,
resilience and growth of the international system.  He noted
that despite the welcome development of China's routine
publication of defense white papers (the most recent being
China's National Defense in 2008 published on January 20,
2009), much more could be said by China about its build-up of
strategic nuclear and conventional capabilities.  China has
left unclear to the international community the purposes and
objectives of the PLA's evolving doctrine and capabilities.

¶15. (C) On the subject of Taiwan, the A/DCM restated U.S.
policy by declaring that the United States remains committed
to our one China policy based on the three joint communiques
and the Taiwan Relations Act.   He said the United States
does not support Taiwan independence and believes that
cross-Strait issues should be resolved peacefully in a manner
acceptable to people on both sides of the Strait, and opposes
unilateral actions by either side to alter the status quo
across the Strait.  He took the opportunity to urge China to
work towards a peaceful resolution of its differences with
Taiwan.  He reminded Zheng that we make defense articles
available to Taiwan to allow it to maintain a credible
defense as provided for in the Taiwan Relations Act, and
urged China to reduce military deployments aimed at Taiwan
and to pursue a peaceful resolution of cross-Strait issues.

¶16. (C) Showing a bit more spark, Zheng said the United
States should recognize that it is "only a member of the
international community" and should follow the norms of
international relations and respect territorial sovereignty
and integrity.  He said that the United States should look at
China's "legitimate defense buildup" in an objective and fair
manner, and discard its Cold War mentality and zero-sum
perception of China-U.S. relations.  He protested that the
Taiwan Relations Act is "a unilateral piece of U.S.
legislation.  The three communiques signed by the United
States constitute the guiding principle for Taiwan policy,
not the TRA," he said.

SUBJECT: PRC "OPPOSES" USNS VICTORIOUS PRESENCE IN CHINA'S EEZ

¶1. (C) Ministry of Foreign Affairs Director General for North
American and Oceanian Affairs Zheng Zeguang called the Charge
to meet for coffee May 6 and during that meeting expressed
"firm opposition" to the presence of the USNS Victorious in
China's Exclusive Economic Zone.  Referring to statements by
the U.S. Department of Defense Spokesman May 5, Zheng noted
that the United States had publicly referred to harassment of
the USNS Victorious by Chinese fishing vessels and had said
that the United States and China will handle the issue
through diplomatic channels.  Reading from several pages of
Chinese talking points, Zheng declared that it was "the
consistent position" of the PRC that ships carrying out
"scientific research" were subject to the UN Convention on
the Law of the Sea and Chinese law and regulations.  The
operations of the USNS Victorious, Zheng said, were in
violation of those laws and regulations because the USNS
Victorious was not granted permission to conduct its
activities in the EEZ.  China was firmly opposed to USNS
ships conducting activities in China's EEZ without
permission, and the United States should stop such activities
and prevent similar incidents in the future.

¶2. (C) Leaving his prepared script, Zheng stressed that it
was "in the interests of bilateral relations to handle these
cases through diplomatic channels."  He said that, in the
event of an incident, the diplomatic channel was "always
open."  Addressing this issue "through loudspeakers" was
"counterproductive, not constructive."  Because of the press
coverage of the U.S. remarks, the Chinese side was "obliged"
to react, Zheng said.  "From the reports, you can see it was
not the Chinese intention to have this kind of incident,"
Zheng added.

¶3. (C) Comment: The atmospherics, including Zheng's body
language and the setting of the demarche at a coffee shop
rather than a formal MFA meeting room, suggested that Zheng
wanted to play down the significance of the representation.
We believe the second set of points, in paragraph 2 above,
was the MFA's way of asking the United States to allow both
sides to finesse the EEZ issue by not publicizing encounters
between Chinese fishing boats and U.S. ships.

7. 在讨论“打击种族主义”时,会议的紧张气氛被缓解了。这个议题是由中方提出加到议程上的。据XXX所说,吴和沈列出了无数的发生在欧洲的种族主义的案例(。。这语气,哈哈)。欧盟方面没有否认或无视中方对此的评论(是赖不掉吧。。。)。XXX说,这给中方树立了好榜样(我勒个去。。。),并使会议气氛缓和。XXX说,中方“似乎意识到欧盟方面是真的在回应”他们对于种族主义的关注。

8. 关于器官摘除,吴说,“Tg大量摘除轮子成员的器官”的论断是粗暴无礼的,同时“许多美国人疯狂热衷于这个谎言”(哈,确实是)。他说在将来Tg可能把器官捐赠作为一个议题进行立法,或规章制度方面的讨论。据英国外交官XXX说,一位英国器官移植方面的医生,正在和Tg合作修订关于器官移植的法律。据称,新的条款规定
(1)公开服刑人员签署的同意捐赠器官的文件;
(2)禁止器官从中国流出到海外;
(3)鼓励中国公民自愿的器官捐赠;
(4)确立“脑死亡”标准;
(5)明确可进行器官移植手术的医院的审核程序。

9. Gronberg就九月三十日在Nangpa Pass发生的开枪打死XZ人的事件,要求Tg进行澄清并进行彻底调查。吴同意进行调查,并承诺一旦有了结果,就告诉欧盟方面。但是他傲慢地把此次事件称作“正常的边界防卫行为”,并告诉欧盟方面出席的人员,说他觉得他们国家的“边界守卫会做同样的事”。会谈前,欧盟人权官员向Tg提交了76个服刑人员的案例。其中11个案例,欧盟方面收到了明确答复,同时中方同意就其他案例给出答复。

10. 据欧盟代表团成员XXX说,在此轮对话中,中方与会者总的来说表现的比以前更加自信,甚至有时显得傲慢。一个表现就是,吴在若干次讨论中,干脆无视与他对话的欧盟代表(翻来覆去就那么几招,早烦了,有本事搞点新的,再搭理你)。据称,沈甚至嘲笑欧盟方面的一些意见(本来就可笑,偏偏某些人还不觉得)。沈抗议称Bern Process(这是嘛?)“冒犯中国尊严”。他说,欧盟必须退出Bern Process,就此对中方施压会产生不良后果。

11. 若干大使说他们已就Nangpa Pass枪击事件提出关切。加拿大大使说加政府曾就此事质询中国驻加大使,但是因中国外交部拒绝接见加驻中使馆官员而作罢(吃饱了撑的。。。)。据瑞典方面称,瑞典zf曾在10月12日向李zx提出此事。一个在XZ的瑞典代表团曾在10月16日向当地官员询问此事,地方官员称这事没听说过。据称,澳大利亚使馆上周曾就此事向中国外交部提交了一份demarche(?)。
