China turns back Lao Airlines flight for failing to comply with ADIZ rules

A Lao Airlines flight—enroute from South Korea’s Gimhae International Airport to the Lao People’s Democratic Republic (LPDR) on July 25—was turned back by Chinese airspace controllers for not having approval to pass through newly imposed Chinese airspace.

The flight, QV916, took off from Gimhae on an inaugural commercial schedule from Korea to the LPDR.

The Lao Airlines Airbus A320 departed from Gimhae around 8 a.m. for its home base in Vientiane. But after one hour’s flight time—which would have put the aircraft over disputed areas of the China Sea—it turned back to Gimhae citing lack of permission to fly through Chinese airspace, according to the Gimhae Airport Authority.

In November 2014, China issued a Notice to Airmen (NOTAM) establishing a new Air Defense Identification Zone (ADIZ) in the East China Sea. The NOTAM called for all aircraft flying through the ADIZ to file pre-flight plans (FPL), aircraft transponder details and communications status with Chinese air traffic authorities in Beijing prior to flying.

When the ADIZ was first announced in 2013, both Japan Airlines and All Nippon Airways stopped submitting flight plans to Beijing prior to overflights, stating that “there was no threat to passenger safety [in] ignoring the Chinese demands.” However, both US airlines and Korean carriers have agreed to the FPL filing requirements made by the Chinese. It is not clear if the Lao Airlines flight had submitted a full FPL prior to departure.

To date, no commercial traffic has been turned back despite the varied carrier response to the Chinese NOTAM requirement.

Unlike most other countries bordering the ADIZ—Japan, Korea, Philippines, Vietnam, Malaysia and Taiwan—Laos has no claim to any of the disputed islands in the South China Sea that are covered by the zone.
