Saddam Hussein and up to 11 top detainees will be transferred tomorrow to Iraqi legal custody,  Iraq's Prime Minister Iyad Allawi has said.      </P>

An arrest warrant will be read to him on Thursday, Mr Allawi added.    </P>
<P>The new Iraqi leader said the former dictator would receive a "just and fair trial".          </P>
<P>However, that is not expected to be for another several months.       </P>
<P>The Iraqi cabinet is still discussing whether to reinstate the death penalty, which was stopped by the US-led Provisional Coalition Authority.      </P>
<P>Saddam is expected to face war crimes charges, including genocide.    </P>
<P>"We would like to show the world that the new Iraq government means business and wants to do business and wants to stabilize Iraq and put it on the road toward democracy and peace," Mr Allawi said.    </P>
<P>"We want to put this bad history behind us and move toward a spirit of national unity and reconciliation in the future."    </P>
<P>Saddam will remain in a US-run jail because the Iraqi government lacks a suitable prison.    </P>
<P>Mr Allawi said Saddam would be allowed a foreign lawyer he asked for one.
