应该是拍卖后先还税款，然后支付按揭，信用卡等其他债务，最后剩下来的才是他的。

呵呵，有人真会洗地，在中国，就算房子抵押后无法还贷破产，如果是唯一一套房产，只要证明是生活必须的（就是不是太过分的超标，比如是什么别墅豪宅），法院也只是能冻结产权，而无权拍卖，也就是说任何情况下都不能把人赶去睡马路。。。。

我简单翻译一下要点，有不对的地方请指教。
